What is the Difference Between Patent and Utility Model?

An invention should have 3 key features in order to obtain a patent:

  1. NOVELTY,
  2. INVENTIVE STEP,
  3. INDUSTRIAL APPLICABILITY

While the patent has these 3 features, it is not necessary for the utility model to have inventive step.

That is, it is enough to be new, it doesn't need to be inventive.

Another difference between the patent and the utility model is the protection period. While the protection period of the patent is 20 years, the protection period of the Utility Model is 10 years.

Patents undergo search and examination processes. However, the utility model undergoes only search process.
